An out-of-town visitor was injured while riding as a passenger in a rideshare vehicle on Mardi Gras Day in New Orleans. Before he hired Flattmann Law, the rideshare company’s insurer offered him $2,500 to settle his claim and sign a release. Heath was visiting New Orleans from out of town during Mardi Gras and, like thousands of other visitors, relied on a ride share service to get around the city.
On Mardi Gras Day, Heath was riding as a passenger in a ride share vehicle when his driver failed to yield at an intersection. Another vehicle crashed into the side of the ride share vehicle, leaving Heath shaken up and injured.
The flight was uncomfortable, and after returning home, Heath continued experiencing soreness and pain, particularly in his upper back. He sought treatment from a chiropractor in his hometown and continued receiving chiropractic care over the next few months.
Fortunately, Heath responded well to conservative treatment and eventually recovered from his injuries without the need for more invasive medical procedures.
Before contacting Flattmann Law, however, Heath had already been dealing directly with the rideshare company’s insurance carrier. The insurer offered him $2,500 to settle his injury claim and sign a release.
Heath did not accept the offer and instead hired Flattmann Law to help with his case.
We gathered the information necessary to document Heath’s injuries and treatment and began negotiating with the insurance company on his behalf. An important part of the claim was demonstrating that although Heath was able to return home immediately after the accident, his injuries did not simply disappear when his vacation ended. He continued experiencing symptoms and required months of treatment after returning home.
After negotiations with the insurance carrier, Flattmann Law ultimately recovered $19,000 for Heath, more than seven times the amount the insurance company had offered before he hired our firm.
Thankfully, Heath made a good recovery and was eventually able to put both his injuries and the accident behind him.
