"Hey, this is Grady with Grady Flattmann Attorneys At Law. In this video we're going to talk about the top three reasons that lawsuits are filed in civil cases. It's important to know that a majority of the time, insurance claims can be resolved without having to file a lawsuit. But sometimes lawsuits are just unavoidable.
In Louisiana a lawsuit must be filed within one year of a date of an accident. If a claim can't be resolved within that time it's like the claim never existed. So if a client walks in my office at the last minute within one year from the date of the accident, sometimes it's just unavoidable that we have to file a lawsuit in order to put our foot in the door and protect that client's rights.
The second reason lawsuits are filed is because a client may be still being treated for their injuries related to the accident and the year is almost expired. In those cases that client's claim is still continuing and can't be determined as to its monetary value, and a lawsuit must be filed in order again, to preserve that client's rights.
The third reason a lawsuit is filed is when the insurance company is denying fault for the accident or being unreasonable. Lawsuits are the only option in that case and it allows us to collect more information, facts, and evidence on both sides so that the claim can be even more properly evaluated.
But it's important to know that even when you file a lawsuit or even if you file a lawsuit, a lawsuit can be resolved without having to go in front of the court, in front of the jury or a judge to have your claim decided by them. Also, we never file lawsuits without making sure our client's questions are answered and that they're 100% on board with the process.
